This privacy policy (this “Policy”) explains how personal information is collected, used, and disclosed by BookQik app, a software platform developed by Bookablebiz Private Limited, and all its designated agents, employees and subsidiaries (“Bookablebiz.in ”, “Bookablebiz Direct” or “we”). This Policy applies to consumer users (individually referred to as “you”) of BookQik ’s websites, applications, and other online services (collectively, our “Sites”).
Other third parties, such as small and medium businesses (“Vendors”) at which you make reservations through our Sites, and social networks that you use in connection with our Sites, may also collect, use, and share information about you. This Policy does not cover such third parties or their services. For information about third-party privacy practices, please consult with them directly.
Part I – Types of Information We Collect and the Methods of Collection
We collect information about you in various ways when you use our Platform Services. We use this information to, among other things, provide the functionality and improve the quality of our Platform Services and personalize your experience. We may collect the following categories of personal information from you:
- Identifiers: such as your name, surname, business name, email address, postal address, phone number (including your mobile phone number), avatar, image or profile photo.
- Demographic information: such as your age, birthdate, and gender.
- Financial information: such as billing information for use by our Payment Processor and, for certain services on our platform.
- Commercial information: such as, survey responses, current and prior appointments details, favourite Vendors, special Vendor requests, passwords, contact information of people you add to, or notify of, your appointments through our Platform.
- Location information: such as your mobile device ID, your precise location data, and the Vendor search locations you select, which are collected if you use our software application, either to book an appointment or to pay.
- Inferences regarding your preferences and other characteristics: such as assessment of the types of products or services you may have interest in made by Bookablebiz Direct at the basis of personal information provided by you and described in points above.
Users can check or edit your personal data that they have provided to us at any time by going to any of our Vendors “My Account” in the Booking services for the vendor brand and under their business brand.
We may also obtain information from other sources, such as third-party websites, applications, and services (each, a “Third-Party Platform”), through which you connect with our Sites and combine that with information we collect on our Sites.
When you or your customers use our Platform Services, some information is automatically collected. For example, when users visit your branded site we provide by default, we may automatically collect your users location, computer operating system, Internet Protocol (IP) address, access times, browser type and language, and the website you visited before our Sites. We also collect information about your users usage and activity on our Sites using certain technologies, such as:
- Cookies. We may automatically collect information using “cookies” and similar technology. Cookies are small data files that may have unique identifiers and reside, among other places, on computer or mobile device, in emails we send, and on our web pages. Among other things, cookies help us improve our Sites and your experience. We use cookies to see which areas and features of our Sites are popular and to count visits to our Sites. We may access information contained in cookies placed on your device by a Third-Party Platform as permitted by the terms of your agreement and privacy settings with such Third-Party Platform. We may share this information with the Third-Party Platform for its use as permitted by the terms of your agreement and privacy settings with such Third-Party Platform.
- Web Beacons. We may collect information using web beacons. Web beacons are electronic images that may be used on our Sites or in our emails. We use web beacons to deliver cookies, count visits, understand usage and campaign effectiveness, and tell whether you open an email and act upon it.
- Do Not Track Signals. We currently do not employ technology that recognizes “do-not-track” signals from your browser. We may engage third parties, such as marketing or analytics partners, who may collect information about your online activities over time and across different websites when you use our Sites.
Part 2 - How We Use Information We Collect.
We use personal information collected through our Platform for the purposes described in this Policy or disclosed to you on our Platform Services or otherwise in connection with our services. We may use your information to:
1. Make and change your appointments made through our Platform Services;
2. Offer, or provide you with, products and services, and the option for customers to make payments through our payment processor with whom customers have made a booking and where prepayment is required to a vendor through our Platform Services.
3. Operate and improve our products, and services;
4. Understand users preferences to enhance, personalize, and customize Platform Services experience and enjoyment using our products and services, such as understanding users appointment history to make recommendations to enhance users experiences.
5. Process and deliver contest entries and rewards as an when applicable;
6. Display relevant advertising;
7. Respond to users comments and questions and provide customer service;
8. Send users information relating to ours and our Client Vendors products and services, including reservation confirmations, receipts, technical notices, updates, security alerts, and support and administrative messages;
9. Communicate with users about contests, offers, promotions, rewards, upcoming events, and other news about products and services offered by our Client Vendors, our Platform Services, our subsidiaries, and affiliates; and our other selected partners;
10. Link or combine with other personal information we get from third parties to help understand your needs and provide you with better service;
11. Authenticate your credit or debit card account information via our payment processor partner.
12. Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity. By providing your mobile phone number, you expressly consent to receive direct dial calls, auto dialled and pre-recorded message calls, and text messages from us relating to our product and services at that number.
Our Platform Services may store and process personal information.
We as a software platform will process your data in order to produce compilations, analyses, statistics for internal needs – for the duration of the agreement and then until the end of the limitation period for claims arising from the agreement or until an objection is raised to data processing for this purpose; for the purpose of implementing new or developing new solutions/features of our systems/applications – until the termination or expiration of the contract or until you object to data processing for this purpose.
Part 3 - How We Share Information.
1. Information Shared with Vendors.
- When users make an appointments or bookings through our Platform servives, their information is provided via our platform to the Vendor with whom users choose to make the appointment. In order to facilitate users appointment, their information is provided to that Vendor, just as it would if they made an appointment by calling the Vendor, emailing the Vendor, or using the Vendor’s website. If yusers provide a mobile phone number, Vendors may send such users text messages or emails regarding their reservation. Some Vendors, through our payment processor, also require users to provide credit or debit card account information for prepayment to secure your appointment or bookable service. When users make an appointment through our Platform services we may also share with the Vendors additional information, such as information about users booking history or information that we collect via Third-Party Platforms. Users also have the option of indicating special preferences or providing comments about their appointment that BookQik will pass on to that Vendor.
- We may share with Vendors summary reports of feedback from clients. If users provide comments about a Vendor through our Platform, these comments may be shared with that Vendor. We will not tie user’s comments with other information that can identify user, but a Vendor may be able to tell who the user is from comments made, particularly if user gives their name in the comments or provide contact information, such as an email address.
- Information users choose to share with a Vendor when they make an appointment and/or pay a Vendor through our Platform Services may be used by the Vendor for its own purposes. Bookablebiz Direct does not control the privacy practices of Vendors. Please contact the Vendor directly if you want to learn about their own privacy practices.
2. Payment Card Information.
- To use certain services on our Platform Services, such as to make appointments with certain Vendors; to make payments on our platform; and to purchase services/products offered by Vendor on their sites using our Platform Services, or other products or services, we may require credit or debit card account information. By submitting user’s credit or debit card account information through our Platform Services, user’s expressly consent to the sharing of their information with our Payment Processor (for India we partner withg Razor Pay) and other third-party service providers, and users further agree to the following terms. Our payment processor collects and processes all payments on behalf of Vendor as stipulated in our Terms of Service: a) when user use a credit or debit card to secure a booking or appointment through our Platform Services, users are effectively providing their credit or debit card account to our payment processor, b) For information about the security of your credit or debit card account information, see Section called “Security of Your Personal Information” below.
3. Information You Share Socially.
- Our Platform Services may allow you to connect and share your actions, comments, content, and information publicly or with friends on Third-Party Platforms such as Facebook or Instagram. Our Platform services may also allow you to connect with, share on, and use Third-Party Platforms, including those on which BookQik has a presence.
- Please be mindful of user’s personal privacy needs and the privacy needs of others as they choose whom to connect with and what to share and make public. We cannot control the privacy or security of information user’s choose to make public or share with others.
- We also do not control the privacy practices of Third-Party Platforms. Please contact those sites and services directly if you want to learn about their privacy practices.
4. Sharing with Others.
- We do not share users personal information with third parties other than as described above and as follows:
- We may share personal information when users authorize us to share your information with other third parties (such as the Vendors at which you make appointments through our Platform Services) for their own marketing purposes, which are subject to the separate privacy policies of such third parties. We may share personal information with affiliates, third-party Vendors, consultants, and other service providers who work for us.
- We may share user’s credit or debit card account information with third parties as described in the section called “Payment Card Information” above.
- We may share aggregate statistical data for the improvement of services offered by our Sites.
- We share personal information with third parties who provide services to us, such as data collection, reporting, ad response measurement, and site analytics, as well as assistance with delivery of relevant marketing messages and advertisements. These third parties may view, edit, or set their own cookies. We and our third-party service providers, advertisers, and/or partners may also place web beacons for these third parties. The use of these technologies by these third parties is subject to their own privacy policies and is not covered by this Policy.
- We do not sell your personal information to third parties.
- We may disclose user’s personal information (i) to comply with laws and to respond to lawful requests and legal process, (ii) to protect the rights and property of BookQik, our agents and customers, and others, including to enforce our agreements, policies, and terms of use, and (iii) in an emergency to protect the personal safety of customers, or any person.
- We may disclose or transfer user’s personal information to a third party if we sell, transfer, divest, or disclose all or a portion of our business or assets to another company in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding.
- We may also share aggregated or de-identified information with third parties at our discretion.
Part 4 - Security of Personal Information
- Together with our Payment Processor, Razor Pay, we take reasonable steps to help protect user’s personal information in an effort to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. When user’s credit or debit card account information is being transmitted to our through our Platform services, it will be protected by encryption technology, such as Secure Sockets Layer (SSL).
- We doe not itself store your credit or debit card account information as this is handled by our Payment Processor, Razor Pay. We do not have direct control or responsibilty for user’s credit or debit card account information, Our conracts with third parties that receive user’s credit or debit card information requires them to keep it secure and confidential.
- Nonetheless, we cannot guarantee that transmissions of your credit or debit card account information or personal information will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by our us or our third-party service providers. We assume no liability or responsibility for disclosure of your information due to error in transmission, unauthorized third-party access, or other causes beyond our control.
- User’s play an important role in keeping their personal information secure. User’s should not share their user name, password, or other security information for their Vendor “My Account” with anyone. If a Vendor receives instructions using your user name and password, it will be considered that user has authorized the instructions.
Part 5 - Promotions Opt-out
You may opt out of receiving promotional emails from BookQik by following the instructions in those emails. If you opt out, we may still send you non-promotional emails, such as emails about your account or our ongoing business relations.
Part 6 - Changes to Policy
We may update or revise this Policy from time to time. You agree that you will review this Policy periodically. You are free to decide whether or not to accept a modified version of this Policy, but accepting this Policy, as modified, is required for you to continue using our Sites. If you do not agree to the terms of this Policy or any modified version of this Policy, you may not be able to proceed further to transact on this site.
